DUI Electronic Blood Seizure Order Application Instructions

- Important: Your DUI field investigation should be complete prior to filling out and submitting the Application for Blood Seizure Order (DUI).
- Do NOT apply for the electronic seizure order unless the suspect:
- Refused consent to the blood draw;
- Did not answer or give a definitive consent when you asked for consent; or
- Is unable to consent or refuse the blood draw (ex: unconscious or otherwise not capable of understanding his/her rights)
- Do NOT apply for the electronic blood seizure order if the DUI suspect is unconscious AND you believe exigent circumstances exist to justify a warrantless search (ex: medical intervention is imminent that would prevent a specimen from being obtained within a reasonable time). In that case, you should direct a phlebotomist to draw blood immediately and thoroughly document in your report all facts and circumstances justifying the exigency. - Make sure you have read your agency’s Implied Consent (also called “Informed Consent”) warning to the suspect prior to applying for the seizure order.
- Review the on-call Justice of the Peace list below. For the date of your application, select the Justice of the Peace for the jurisdiction of where the offense occurred, even if the suspect is now at a different location. If this application is being made for an out-of-county traffic incident and the suspect has been medically transported to a local medical facility (ex: Renown Health), use the on-call Justice of the Peace for the jurisdiction where the medical facility is located (ex: Renown Health = Reno Justice Court).
- AFTER you have completed the Electronic Blood Seizure Application, and BEFORE you click the “SUBMIT” button, call the appropriate Justice of the Peace first to make sure he/she is available. Once you have made sure the judge is available and is aware the electronic application is coming, click the “SUBMIT” button.
NOTE: If you are unable to reach the on-call Judge, or for some reason the Judge is unable to accommodate the warrant request at that time (ex: no access to email), then move on to the next Judge in the rotation to see if he/she can receive the warrant request. Continue this process until you make contact with a Judge who is able to receive the warrant request.
IMPORTANT: AFTER YOU HAVE COMPLETED THE WARRANT APPLICATION, YOU MUST FIRST MAKE CONTACT WITH THE ON-CALL JUDGE TO MAKE SURE HE/SHE KNOWS YOU ARE SUBMITTING THE APPLICATION.
AFTER SUBMITTING THE APPLICATION TO THE JUDGE, IF 15 MINUTES GO BY AND YOU HAVE NOT RECEIVED ANYTHING BACK VIA EMAIL, CALL THE JUDGE AGAIN TO VERIFY YOUR APPLICATION WAS RECEIVED.
