Washoe County HOME Consortium (WCHC) Section 3 Policy

Washoe County, as a member of the Washoe County HOME Consortium (WCHC) in partnership along with City of Reno, City of Sparks and other stakeholders, seeks to provide economic opportunities for low-income residents. This is consistent with Section 3 of the U.S. Department of Housing and Urban Development (HUD) Act of 1968 as amended (24 CFR Part 135.)

The purpose for the Section 3 Program is to ensure that employment and other economic opportunities generated by certain HUD financial assistance shall, to the greatest extent feasible, and consistent with existing Federal, State and local laws and regulations, be directed to low- and very low-income individuals, particularly those who are recipients of government assistance for housing, and to Business Concerns who provide economic opportunities to low- and very low-income persons.

WCHC is in the process of adopting a formal Section 3 program, policy and procedures to provide the framework for its compliance with Section 3 of the HUD Act of 1968, which applies to all employment and economic projects funded in whole or in part by HUD.

Each respondent to Washoe County eligible-procurement opportunities must comply with the WCHC Section 3 Policy, pursuant to the Housing and Development Act of 1968, as amended by Section 915 of the Housing and Community Development Act of 1992.

Who qualifies as Section 3 Residents?
  • Public Housing Residents or [Washoe] YouthBuild program participant; or
  • Persons who live in the area where a HUD-assisted project is located and who have a household income that falls below HUD income limits.

Section 3 Certified Businesses
WCHC offers significant economic opportunities for Section 3 Certified Businesses and maintains a listing of all certified businesses by trade and location.  This list is available to all participating contractors and program partners, to assist in meeting contract goals.
 
What is a Section 3 Business Concern?
A business that:

* Is owned 51 percent or more by Section 3 Residents
* Employs residents for at least 30 percent of its full-time permanent staff, or
* Provides evidence of a commitment to subcontract Section 3 to Section 3 Business Concerns, 25 percent or more of the amount of the awarded contract.

WCHC applies preferences on bids or proposals of Contractors who are Section 3 Certified Business Concerns.  Prior to receiving a preference, Contractors must demonstrate both responsiveness to the bid/proposal and responsibility to complete the project as specified within the solicitation.
