Evictions
An eviction is the act or process of legally removing a person from land or rental property. In Nevada, the eviction process typically starts with the landlord serving the tenant with an eviction notice. If the tenant does not move out or otherwise remedy the situation, the landlord can then proceed with filing for an eviction order in the Justice Court.
Types of Evictions
There are a number of different reasons why a landlord may evict a tenant. These may include:- Non-payment of rent
- Lease violation
- Nuisance
- Change of ownership
- No-cause
- Failure to vacate premises after end of lease term
Notice Requirements
Before a landlord may file for an eviction order from the court, the landlord must typically serve notice on the tenant. The type of notice that is required depends on the reason for the eviction. Some types of notices require a second, Unlawful Detainer Notice, before the landlord may seek an Eviction Order from the court.

Eviction Proceedings
If the tenant does not comply with the eviction notice(s) provided by the landlord, the landlord may file an eviction lawsuit in the Justice Court where the rental property is located. There are two types of eviction actions that may be brought in Justice Court, depending on the reason for the eviction. These include:
- Summary Eviction
- Unlawful Detainer
Service of Process
Service of a Summons and Complaint (formal Unlawful Detainer action) or Summary Eviction Notice (Summary Eviction proceedings) should be performed by the Washoe County Sheriff's Department or a private process server. Landlords cannot serve the documents themselves.
Lockout Order
If the tenant takes no action within the time period allowed after receiving a Notice to Pay Rent or Quit or a Summary Eviction Notice Notice, the landlord may apply to the Justice Court for a Lockout Order. The Order must be signed by a Judge and may only be served by the Washoe County Sheriff's Office. The sheriff will serve the eviction order on the tenant, who will be locked out 24-36 hours after service of the Lockout Order.
