NOTE:  Items on the agenda may be taken out of order; combined with other items; removed from the agenda; moved to the agenda of another meeting; moved to or from the Consent section; or may be voted on in a block.  Items with a specific time designation will not be heard prior to the stated time, but may be heard later.  Items listed in the Consent section of the agenda are voted on as a block and will not be read or considered separately unless removed from the Consent section.  The Board of County Commissioners may take short breaks approximately every 90 minutes.

Time Limits.  Public comments are welcomed during the Public Comment periods for all matters, whether listed on the agenda or not, and are limited to three minutes per person.  Additionally, public comment of three minutes per person will be heard during individually numbered items on the agenda.  Persons are invited to submit comments in writing on the agenda items and/or attend and make comment on that item at the Commission meeting.  Persons may not allocate unused time to other speakers.

 

Forum Restrictions and Orderly Conduct of Business.  The Board of County Commissioners conducts the business of Washoe County and its citizens during its meetings.  The presiding officer may order the removal of any person whose statement or other conduct disrupts the orderly, efficient or safe conduct of the meeting.  Warnings against disruptive comments or behavior may or may not be given prior to removal.  The viewpoint of a speaker will not be restricted, but reasonable restrictions may be imposed upon the time, place and manner of speech.  Irrelevant and unduly repetitious statements and personal attacks which antagonize or incite others are examples of speech that may be reasonably limited.

 

Responses to Public Comments.  The County Commission can deliberate or take action only if a matter has been listed on an agenda properly posted prior to the meeting.  During the public comment period, speakers may address matters listed or not listed on the published agenda.  The Open Meeting Law does not expressly prohibit responses to public comments by the Commission.  However, responses from Commissioners to unlisted public comment topics could become deliberation on a matter without notice to the public.  On the advice of legal counsel and to ensure the public has notice of all matters the Commission will consider, Commissioners may choose not to respond to public comments, except to correct factual inaccuracies, ask for County staff action or to ask that a matter be listed on a future agenda.  The Commission may do this either during the public comment item or during the following item:  “*Commissioners’/Manager’s Announcements, Requests for Information, Topics for Future Agendas and Statements Relating to Items Not on the Agenda”.

6.A.      Approve minutes of the regular Washoe County Board of Commissioners meetings of July 14, 2015 and July 21, 2015.

 

6.B        Approve the professional services agreement for facility planning and space programming for the Second Judicial District Court between the Second Judicial District Court and the National Center for State Courts in the amount of [$116,000], from August 2015 to January 2016.  District Court.  (All Commission Districts.)

 

6.C.      Approve acceptance of a continuation grant [$43,392; no County match] from the Annie E. Casey Foundation to support activities related to the replication of the Juvenile Detention Alternatives Initiative (JDAI); retroactive from July 1, 2015; and if approved, direct the Comptroller’s Office to make the necessary budget adjustments.  Juvenile Services.  (All Commission Districts.)

 

6.D.      Acknowledge Receipt of Status Report of Commissary Fund submitted by the Washoe County Sheriff’s Office Commissary Committee for fiscal year 14/15.  Sheriff.  (All Commission Districts.)

 

Community Services.

 

6.E.1.     Approve a Water Rights Deed transferring 6.06 acre-feet of water rights from Washoe County to Brien B. Walters. (Commission District 2.)

 

6.E.2.     Authorize the Community Services Department Director to modify the previously approved Agreement between Washoe County and Frederic Apcar Productions, to hold a multi-day country music genre event with food and lifestyle components at Rancho San Rafael Regional Park, October 3-4, 2015.  These modifications would be limited to date changes of the event.  (Commission District 3.)

 

6.E.3      Adopt a Resolution accepting real property (currently APN(s) 148-122-11, 148-122-12, totaling 1.1-acres) for use as a non-motorized public trail corridor within the Galena Canyon Subdivision; and approve a Grant of Easement for Water facilities between Washoe County and Truckee Meadows Water Authority (currently APN(s)148-122-11, 148-122-12, 148-282-03, 148-301-03, 148-302-01 and 148-303-03); and direct the Clerk’s Office to record the Resolution and Grant of Easement.  (Commission District 2.)

 

6.E.4.     Reject all bids for the STMWRF Utility Operations Building Project.   (Commission District 2.)

6.F.1.     Approve retroactive to July 1, 2015 Grant Program Contracts FY 2015-2016 for grants in the following amounts: Access to Healthcare Network [$31,500]; Incline Village Community Hospital Foundation [$27,000], authorize the County Manager or his designee to sign the contracts, and approve Resolutions necessary for same.   (All Commission Districts.)

 

6.F.2      Approval of a net zero budget adjustment in order to accommodate services and supplies expenditures, including food purchases and travel, within the Manager’s Office.  Emergency Management program approved budget for fiscal year 2015-2016 (net $0); and direct the Comptroller’s Office to make the appropriate budget adjustments.  (All Commission Districts.)

 

6.F.3.     Appoint one individual representing Washoe County from the business sector to the Western Nevada Development District Board for a term of two (2) years [No fiscal impact].  (All Commission Districts.)

 

6.F.4.     Approve a request for sponsorship of the 2015 Great Reno Balloon Race which will be held at Rancho San Rafael Regional Park September 8-14, 2015. Washoe County would waive park facility rental and use fees [$6,000] in consideration of Washoe County being recognized as a Major Sponsor; and authorize the County Manager to sign the 2015 Agreement.  (Commission District 3.)

8.        Recommendation to accept a FHWA Recreational Trails Program Grant, administered through Nevada State Parks for the Sun Valley Regional Park Enhancement Project [award amount of $140,270 with a required match of $39,658 in indirect costs and volunteer labor] with a term to December 31, 2017; and authorize the Community Services Department Director to sign the grant agreement and all associated documents on behalf of the County; and direct the Comptroller’s Office to make the appropriate budget adjustments.  Community Services.  (Commission District 5.)

 

9.        Recommendation to approve grant agreement between William N. Pennington Foundation and Washoe County for park infrastructure improvements totaling [$314,000; no match required]; authorize the Community Services Department Director to sign the grant agreement, reports, and any subsequent documents related to the grant on behalf of the County; and direct the Comptroller’s Office to make the appropriate budget adjustments.  Community Services.  (All Commission Districts.)

 

10.        Recommendation to approve an Agreement for Professional Consulting Services between Washoe County and NewFields Companies LLC., for a six month term, to provide inspection and material testing services during construction of the Huffaker Hills Effluent Storage Reservoir – Phase 2 Liner Expansion Project [$183,199].  Community Services.  (Commission District 2.)

 

11.        Recommendation to approve Community Development Block Grant from the Nevada Governor’s Office of Economic Development in the amount of [$152,454; match $110,041 cash and in-kind] Rural Senior Ambassador Program, grant period retroactive from July 1, 2015 through December 31, 2016 and if accepted, authorize Chairman to execute grant documents; and direct the Comptroller’s Office to make the appropriate budget adjustments.  Senior Services.  (All Commission Districts.)

 

12.      Discussion and possible action to approve a second extension of existing Collective Bargaining Agreements beyond the current August 14, 2015 extension date.  Human Resources.  (All Commission Districts.)

 

13.      Recommendation to approve a 3% Cost of Living Increase to base wages for Unclassified Management, Non-Represented Confidential employees, District Court employees, Justice Courts employees (excluding Justices of the Peace), and Juvenile Services employees effective July 1, 2015.   The Fiscal Year 2015/2016 impact including PERS and Medicare is estimated at approximately $1,255,911.  Human Resources.  (All Commission Districts.)

 

14.      Discussion and possible approval of the Truckee Meadows Regional Planning Agency payment of $205,162, paid in quarterly installments, as Washoe County's share in annual funding for the Truckee Meadows Regional Planning Agency to cover the fiscal year from July 1, 2015, through June 30, 2016.  Manager.  (All Commission Districts.)

 

15.      Recommendation to approve activating the Sun Valley Citizen Advisory Board for current fiscal year 2015-2016.  [Fiscal Impact $2,475.].  Manager.  (Commission Districts 3 and 5.)

 

16.        Recommendation to (1) Approve a resolution to sponsor an amendment of the 2012 Truckee Meadows Regional Plan, pursuant to NRS 278.0272(7), to amend the Electrical Utility Corridors South map to include the following: (A) a 585 acre solar array field and a new substation in the area of eastern Washoe County north of the Tracy Power plant to the north of I-80 on Assessor’s Parcel Number 84-110-26; and (B) a new utility corridor for overhead transmission lines which cross over Assessor’s Parcel Numbers 84-110-26, 84-110-24, 84-110-27 and connect to the NV Energy switching yard on Assessor’s Parcel Number 84-110-29, all in support of the construction of a project of regional significance known as the Turquoise Solar LLC solar energy project pursuant to the related and pending special use permit application in SW15-002; and (2) If approved, authorize the Chair to execute the resolution sponsoring the proposed amendment.  Community Services.  (Commission District 4.)

 

17.        Public Hearing and possible action 1) To consider an application by Southwest Gas Corporation for a non-exclusive franchise agreement to provide natural and other gas service to portions of Washoe County,  including any objections on the matter; 2) If determined to be in the best interests of the residents of Washoe County, to approve a Franchise Agreement between Southwest Gas Corporation and the County of Washoe, retroactive to May 1, 2015, effective through April 30, 2040, fixing the terms and prescribing the conditions pursuant to which the franchise is to be granted, the character or kinds of service to be rendered, the maximum rates to be charged for the service, and such other matters as may be properly connected therewith; 3) If the Franchise Agreement is approved, to adopt a Resolution Authorizing and Approving the Issuance of a Non-Exclusive Franchise to Southwest Gas Corporation to Supply Natural Gas to Portions of Washoe County, Nevada; and 4) If the Franchise Agreement is approved, to approve an associated Agreement to Pay Annually to Washoe County 2% of the franchisee’s Net Profits under the franchise for the Benefit of the County School District Fund of Washoe County, State of Nevada.  (All Commission Districts.)  This Item continued from the July 14, 2015 County Commission meeting.

 

18.        Second reading and possible adoption of an ordinance amending Chapter 25 of the Washoe County Code (Business Licenses, Permits and Regulations), adding Section 25.1515 (Boundaries of Certain Districts) to establish the boundaries of a certain district for the imposition of a surcharge on hotel room rentals as required by S.B. 312; and providing for other matters properly relating thereto.  District Attorney.  ( All Commission District.)

 

19.        Possible Closed Session for the purpose of discussing labor negotiations with Washoe County, Truckee Meadows Fire Protection District and/or Sierra Fire Protection District per NRS 288.220.
